SGA Bylaws

Article IV. General Assembly Composition

The General Assembly shall be composed of an elected President, an elected Vice President, seven elected Senators, and the SGA Advisor. The SGA Advisor shall be the TMCC Coordinator for Student Life and Development (SLD) or designee.

Article V. Responsibilities

Section 1. The SGA President shall:

1. Serve as the direct head of the General Assembly.
2. Attend the TMCC President's Planning Council, TMCC Institutional Advisory Council, TMCC Faculty Senate, Nevada Student Alliance, and NSHE Board of Regents meetings.

Section 2. The SGA Vice President shall:

1. Act as the direct head of the General Assembly when the SGA President is unable to do so or when requested by the SGA President.
2. Attend the TMCC President's Planning Council.
3. Communicate with the dean of each TMCC academic division in order to identify and support the needs of the students within each division.

Section 3. The SGA Senators shall:

1. Propose one or more projects with specified timelines to the General Assembly for approval throughout their term.
2. After project approval, create and propose a project marketing plan and specified timeline to the General Assembly.
3. Meet approved project timelines.
4. Provide updates on the progress of each project at each regular General Assembly meeting.
5. Additional tasks and special assignments as requested by the SGA President, Vice President, and/or SGA Advisor.

Section 4. All voting SGA General Assembly members shall:

1. Adhere to the SGA Constitution, Bylaws, and Operations Manual.
2. Post and maintain required office hours per week.
3. Attend all SGA trainings and retreats. Exceptions can be made at the discretion of the SGA Advisor.
4. Check and respond to emails on a daily basis during the academic year, not including holidays and academic breaks.
5. Attend meetings as requested by the SGA President.
6. Not miss more than two regular SGA General Assembly meetings per semester, unless an absence is approved by the SGA Advisor.
7. Practice appropriate behavior when on hours or in the SGA Office as outlined in the SGA Operations Manual.
8. Abide by the code of ethical standards established in NRS 281A.400.

Section 5. Time Commitment

SGA General Assembly members shall work a minimum of four office hours per week, not including General Assembly meeting times. Each General Assembly member shall be permitted to work a maximum number of hours per week during the Fall and Spring Semester as follows.

• President: 20 hours per week.
• Vice President: 15 hours per week.
• Senators: 12 hours per week.

SGA General Assembly members may not work above specified maximum hours unless pre-approved by the General Assembly.

General Assembly members may not work outside the hours of 8 a.m. to 5 p.m., Monday through Friday, or in excess of 8 hours per day unless pre-approved by the SGA Advisor in accordance with applicable TMCC policies and procedures.

General Assembly members must attend all regular General Assembly meetings. Members are expected to schedule classes around these times, and must stay the duration of the meetings, unless an absence is approved by the SGA Advisor.

SGA General Assembly members may not work during academic breaks unless approved by the SGA Advisor. Absences due to sickness or extenuating circumstances may be excused by the SGA Advisor.

Section 6. Conflicts of Interest

1. Declaration. SGA General Assembly members are expected to declare a potential or actual conflict of interest during SGA General Assembly meetings prior to consideration of any matter causing a potential or actual conflict.
2. Potential conflict. A potential conflict of interest exists when an action taken by a SGA General Assembly member could reasonably be expected to have a financial impact on that member, a relative, or a business with which the member or member’s relative is associated. The SGA General Assembly member may participate in an action after declaring the potential conflict and announcing its nature.
3. Actual conflict. An actual conflict of interest exists when an action taken by a SGA General Assembly member would be reasonably certain to result in a special benefit or detriment to the member, a relative, or a business with which the member or member’s relative is associated. The SGA General Assembly member must then refrain from taking any official action after declaring the actual conflict and announcing its nature.

Meetings shall comply with the requirements regarding disclosure of conflicts of interest as established in NRS 281A.420

Article VI. Compensation

Approved April 23, 2024

SGA General Assembly members fulfilling their duties shall receive an hourly wage as follows:

• President: $18
• Vice President: $17
• Senators: $16

Article VII. SGA Committees

Section 1. Creation

Standing Committee. A standing committee shall be one established by the SGA Bylaws and which meets regularly during the Fall and Spring Semesters.

Ad Hoc Committee. An ad hoc committee shall be temporarily established by the SGA President to perform a special function when that function is outside the power of the SGA General Assembly or a current committee. An ad hoc committee shall be dissolved after its function has been performed. An ad hoc committee shall not endure past the term in which it was created.

Section 2. Finance Committee

The Finance Committee shall be a standing committee of the SGA General Assembly, shall develop and recommend to the SGA General Assembly the annual SGA budgets for the following fiscal year, and shall review and approve funding requests in accordance with the SGA Operations Manual.

1. The Finance Committee shall be comprised of the following members:
   
   1. The SGA Vice President, who shall serve as the Finance Committee Chair.
   2. Two SGA General Assembly members, appointed by the Finance Committee Chair.
   3. The SGA Advisor, as a non-voting member.
2. Appointments made by the Finance Committee Chair do not need to be made during a Finance Committee meeting.
3. Finance Committee meeting dates, times and locations shall be determined by the Finance Committee Chair as necessary to perform the committee’s required functions.

Section 3. Mental Health Advisory Committee (MHAC)

The Mental Health Advisory Committee shall be a standing committee of the SGA General Assembly, shall develop and recommend to the SGA General Assembly action plans for protecting student’s mental health, and shall review the progress made in achieving this goal in accordance with the SGA Operations Manual.

1. The Mental Health Advisory Committee (MHAC) shall be comprised of the following members:
   • Olga Mesina, who shall serve as the MHAC Chair.
   • An SGA General Assembly Member appointed by the SGA Vice President, who shall serve as chair when Olga Mesina is unable to serve.
   • An additional SGA General Assembly member, appointed by the SGA Vice President.
   • The SGA Advisor, as a non-voting member.
2. Appointments made by the MHAC Chair do not need to be made during a MHAC meeting.
3. MHAC meeting dates, times and locations shall be determined by the MHAC Chair as necessary to perform the committee’s required functions.

Section 4. Committee Rules and Regulations

1. All SGA committee meeting agendas, minutes, and audio recordings shall be made available by the SLD Office in accordance with the Nevada Open Meeting Law.
2. SGA committee chairs shall report to the SGA General Assembly at regular General Assembly meetings.
3. SGA committees shall be composed of a chair and at least two General Assembly members.
4. An SGA General Assembly member may not chair more than one SGA Committee at a time.

Article VIII. General Assembly Meetings

Regular meetings of the SGA General Assembly shall be held starting the week before instruction begins for each Fall and Spring Semester and for the duration of each Fall and Spring Semester unless otherwise noted. The SGA President shall determine the time and place of each meeting.

Special meetings of the SGA General Assembly shall be called in compliance with the SGA Constitution.

Article IX. Elections and Vacancies

Section 1. Timing

SGA General Assembly members shall be elected by the TMCC student body every Spring Semester to serve one term as outlined in the SGA Constitution. The candidate who receives the highest number of votes for each position shall be elected. SGA special election dates shall be determined by the SGA President.

Section 2. Eligibility of Voters

TMCC students currently enrolled in a minimum of one half-credit shall be eligible to cast ballots.

Section 3. Vacancies

If a student submits an application to fill a vacancy in the SGA General Assembly, the application shall be considered by the SGA President. The SGA President may appoint an applicant to the vacant position with approval of the General Assembly.

Section 4. Recall

A recall may be initiated at any time during a member’s term to remove a SGA General Assembly member from office.

1. Any current TMCC student may initiate a recall.
2. Reason(s) for a recall and the name(s) of the person(s) to be recalled must be on a petition. Ten percent of the students currently enrolled at TMCC must sign the petition. The SGA Advisor shall authenticate the petition and notify the SGA General Assembly of the recall petition. The ad hoc committee will then be created to address the recall petition. The committee may remove the General Assembly member in question from office by a majority vote.
3. General Assembly members removed from office by recall shall be allowed to apply for any SGA General Assembly position, provided they meet all eligibility requirements.

Article X. Probation, Impeachment and Appeal Procedures

Section 1. Probation

1. Misconduct by an SGA General Assembly member shall be reported in writing to the SGA President or SGA Advisor, detailing the member in question, the action committed and the governing procedure(s) violated.
2. A meeting will be called by the SGA President or SGA Advisor and shall consist of the SGA President, SGA Advisor and the member to review the potential misconduct and to give the member an opportunity to respond.
3. If it is determined by the SGA President or SGA Advisor that misconduct has occurred, the member:
   
   1. May be placed on an agenda for potential probation
   2. May elect to waive placement on the agenda and to go on probation by written consent.
4. If the member is placed on probation, the duration of probation will be 30 consecutive days from the day probation is imposed.
5. If a General Assembly member on probation fails to improve or change their actions which caused the probation, the member may be subject to impeachment.

Section 2. Impeachment

1. If anybody witnesses an action by any member of the SGA General Assembly that is grounds for impeachment, the person shall report such action in writing to the SGA President or SGA Advisor. The report shall detail the member in question, the action committed, and the governing procedure(s) violated.
2. A meeting will be called by the SGA President or SGA Advisor, and shall consist of the SGA President, SGA Advisor and the member to review the action and give the member a chance to respond.
3. If it is determined by the SGA President or SGA Advisor that the action of the member constitutes grounds for impeachment, the member shall be placed on an agenda for possible impeachment.
4. Members may be impeached by a two-thirds majority vote of the SGA General Assembly at a regular or special SGA General Assembly meeting.
5. If the member is not impeached, but was previously on probation, the member shall carry out the remaining days of their probation as previously imposed.

Section 3. Appeals

SGA General Assembly members who have been impeached shall have the right to appeal the impeachment as follows:

1. The member shall fill out an appeal form.
2. The appeal shall be reviewed by the Student Life and Development Director. If the director determines that the impeachment was unjust, the member shall be put on the agenda for re-evaluation by the SGA General Assembly based on the director’s recommendation.

Article XI. Powers of the General Assembly

Section 1. Recognized Student Organizations

The SGA General Assembly shall have the power to establish policies with respect to the recognition of student organizations.

Section 2. Event Co-Sponsorship

The SGA General Assembly shall have the power to co-sponsor SGA events with entities outside TMCC with approval by a two-thirds majority vote of the General Assembly.

Section 3. SGA Budget

The SGA General Assembly shall have the power to set a budget, as recommended by the Finance Committee, for the SGA annually in the Spring Semester. The budget shall include allocations for:

1. Programs and events
2. Recognized Student Organizations
3. Student Life and Development Staff
   
   1. Administrative, Faculty
   2. Administrative, Student(s)
   3. Front Desk, Student(s)
   4. Recognized Student Organizations, Student(s)
   5. Programs and Events, Student(s)

Article XII. Amendments to Bylaws

The SGA General Assembly may approve amendments to these bylaws by a two-thirds majority vote. Amendments to these bylaws shall take effect immediately upon approval by the SGA General Assembly, or as otherwise noted at the time of approval.
